先週のマル激は、「冤罪事件を繰り返さない為には」というテーマで、ゲストは布川冤罪事件の被害者、桜井昌司さんでした。

桜井さんは、29年間を刑務所で過ごし、もう一人の被害者である杉山卓男さんともども無罪が確定するまで、44年の月日が流れました。
アリバイもあり、現場の髪の毛や指紋とも一致しなかった彼らが無期懲役になったのは何故か。
嘘による誘導と拷問により強要した自白が証拠として有効とされた為。
検察が無罪証拠を隠蔽した為。
度々マル激で取り上げられる内容なので、もう前ほどは驚きませんが、今回は当事者自らが語っていたので、特に訴えるものがあり、聞き入ってしまいました。
これまでも政治家の犯罪行為が追及されてない状況に、日本はもう法治国家じゃないと感じることは多々ありましたが、もしかすると一度も法治国家ではなかったのかもしれないですね。大なり小なり他の国でも起こっていることなのかもしれませんが・・・。
正直布川事件のことは知らなかったので、もう少し文献などあたってみたいと思いますが、いくつか今回印象に残ったことがありました。
- 刑事訴訟法は警察や検察が作るものではない、主権者たる国民が作るもの
- 多くの人は、どうせ悪い人なのだから、拷問されてもしょうがないと思っている、自分には関係ないと思っている
- 証拠捏造などの行為を厳罰化すれば状況はすぐに変わる、誰も冤罪の責任をとらない仕組みになっていることが問題だ（それにしても、良心の呵責ってものはないのか？）
桜井さんは服役中も、毎日一生懸命、楽しく明るく生きたそうです。
自身はやっていないということを知っていることと、支援者の存在のお陰で、心が折れなかったそうです。
（余談ですが支援者の中に、バリトン歌手の佐藤光政さんがいたそうで、私は聴いたことなかったのですが、母は実は友の会まで入っており、私も彼の音楽を聴いてみたくなりました。）
私は理不尽な責め苦を受けることが大の苦手なので、私だったらあっという間に心が折れてしまいそうです。
桜井さんは末期がんとのことですが、現在も冤罪防止の為に活動されていて、ものすごい逞しさに頭が下がると同時に、その姿に励まされました。冤罪事件の被害者というイメージからは想像もつかない程エネルギッシュで率直で、話を聞いていて爽快なくらいでした。

冬のボーナスが入ったので、普段お世話になっている母と取り急ぎ、ビストロサイクルというお店にランチに行きました。

Last week’s Marugeki was about how not to repeat Wrongful Convictions, and the guest speaker was Shoji Sakurai, the victim of the false accusation of so called Fukawa Case.

He spent 29 years in prison and it took 44 years to be confirmed that he, as well as another victim Takao Sugiyama, are innocent.
They had alibi, neither their hair nor fingerprint were found in the site. Then why did they become life imprisonment?
Because their confessions forced by prosecutors by inductions through lies and torture are accepted as valid.
Because prosecutors hid the proof of their innocence.
These are the things often introduced at Marugeki, so I wasn’t surprised than before, but as this time was the telling from the person himself, it was so striking that naturally made me listen hard.
Up until now, seeing the politicians’ criminal acts are dismissed, I often thought that Japan might not be a country governed by law anymore, but perhaps Japan never has been governed by law, though similar things might happen to some extent in most of countries….
I didn’t know about the case to be honest, so I’d like to read some more, but things below were striking to me.
- Criminal Procedure Law, which is internationally infamous, is not something police or prosecutor makes, this is what sovereign people makes.
- Many people think that it’s just the way it is if bad person is tortured, and it’s nothing to do with them.
- The situation will change soon, once things such as fabrication of evidence will become severely punished. That’s the problem that no one takes responsibility for Wrongful Convictions. (… don’t they feel guilty at all to any rate?)
Sakurai-san stayed cheerful and tried to have fun, and lived hard everyday, even in prison.
He could keep saving his heart, because he knew that he didn’t kill, and because of the supporters.
(As an aside, his supporters included baritone singer, Mitsumasa Sato. I’ve never listened to his singing though my mother is actually fan club member of his. Now I’ve become interested in his music now.)
I hate being accused irrationally, so I would be brokenhearted instantly if I were him.
While taking off my hat that he is currently stage 4 cancer but stays strong and continues his activity to prevent Wrongful Convictions, I’m encouraged by his way of living. Unlike my image of victim of Wrongful Conviction, he is so energetic and straight, that I even felt invigorating.
Having said that, today’s ‘time for that’
As I got my winter bonus, I went to lunch with my mother I’m indebted, in a bistro called Bistro Cycle.
It was so yummy and voluminous that I couldn’t have a bean jam bread prepared for tea time later!
